Privacy Policy

This privacy policy (this “Policy”) describes the policies and procedures of Peterson Health Analytics LLC  (“we,” “our,” “us”) with respect to personal data collected, held, used or processed by, or on behalf of, us, including when you use our website at petersonhealthanalytics.com (the “Site”).This Policy also covers the measures taken to protect the confidentiality, integrity and security of that personal data, and your rights regarding such personal data. This Policy applies solely to personal data collected through the Site. If you engage with our health analytics services, additional privacy notices and terms may govern the collection and use of your information in that context.

By visiting the Site, you acknowledge that you have read this Policy, which we may update at any time. If we update this Policy, we will post the updated version here. Any such changes will be effective as to you when you first access the Site after we post the changes here. If we make any material changes in the way we collect, hold, use, process or share your personal data, we will endeavor to provide you with appropriate notice.

This Policy sets out:

  • the types of personal data that we collect from individuals when they use the Site;
  • the purposes and legal basis for our processing and use of individuals’ personal data;
  • how we may disclose or use personal data; and
  • individuals’ rights with respect to our use or disclosure of their personal data.

Who Controls the Data We Collect

We are a data controller with respect to the data you submit to us through the Site. Where we process personal data on behalf of our clients in connection with our health analytics services, we act as a data processor (or business associate, as applicable) and process such data solely in accordance with our clients’ instructions and applicable agreements. This Policy does not govern data that we process in our capacity as a processor or business associate.

What Personal Data Do We Collect

We provide you with the opportunity to submit your personal data to inquire about the services we provide.  This includes identifiers such as your first name, last name, title, company affiliation, email address, and phone number. If you do so, we will use this personal data for the purpose of providing you with information about our services and/or other information that we believe you will find relevant.

We also collect information automatically when you visit the Site through cookies, pixels, or other tracking technologies (collectively, “cookies” for purposes of this Policy).  The information collected through cookies may include IP address, geolocation information, information about the computer or other device you use to interact with the Site, the type of operating system and browser you use, access times, pages viewed, URLs clicked on, and the pages visited before navigating to the Site.

Cookies are small text files stored by your browser on your computer or other device when you visit websites, which allow for the collection of certain information about your use of the websites. Why We Collect and Process Personal Data

We may process the personal data described in this Policy for the following purposes, as detailed in this Policy:

  • for website analytics, and to monitor, improve and safeguard use of the Site;
  • to provide targeted advertisements to you in connection with your use of the Site;

How and With Whom Do We Share Personal Data

We may share your personal data as set forth below:

  • with our affiliates, including for their own marketing purposes
  • with our service providers, including website hosting providers for the purpose of providing and maintaining the Site;
  • with our customer relationship management (CRM) vendor;
  • with analytics provider, Google Analytics, to help improve and optimize the Site (to learn more about Google Analytics and how Google collects and processes data, see www.google.com/policies/privacy/partners);
  • with our third-party advertising partners;
  • if we transfer or acquire any businesses or assets or merge any business or operations into or with those of another person or entity, in which case we may disclose your personal data to the prospective counterparty in such transaction and such data may be one of the assets transferred in such transaction;
  • to comply with applicable laws, regulations, subpoenas, legal process, governmental investigations, regulatory requests or inquiries, to cooperate with law enforcement, to assert or defend against legal claims, to protect our and others’ rights, property, or safety, and for the purposes of crime and fraud prevention and remediation; and
  • to any other party with your consent.

Your Rights

Depending on where you reside, you have various rights with respect to our use, processing and sharing of your personal data, as described below. There may be exceptions to these rights under applicable law. Please use the “Contact Information” described at the bottom of this Policy if you wish to contact us to exercise any of these rights, or if you wish to appeal a decision concerning any of these rights.

We will not deny you services, charge you a different price, provide a different level or quality of services or otherwise discriminate against you just because you exercised any of these rights; however, if you decline to provide your personal data or ask us to delete it or stop disclosing it, certain website functionality may not be available to you.

Only you, or a person whom you authorize to act on your behalf, may make a request related to your personal data. Except for requests to opt-out of the sale or sharing of personal data (described below), the request must:

  • provide sufficient information for us to reasonably verify you are the person about whom we collected personal data or an authorized representative of such person; and
  • describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

Except with respect to requests to opt-out of the sharing or sale of personal data (described below), we cannot respond to your request or provide you with personal data if you do not take the foregoing actions. We will use personal data provided in a request only to verify your identity or authority to make the request.

  • Access: You may request a copy of the personal data that we have collected, used, or shared about you, and why we collected, used or shared that personal data, including the categories of personal data collected, the specific items of personal data collected, the categories of sources from which we collected personal data, the purposes for which we use the personal data, the categories of third parties with whom we share the personal data, and the categories of personal data that we disclose to third parties.
  • Accuracy/Correction: We aim to keep your personal data accurate, current, and complete. You may contact us to request that we correct any inaccurate or incomplete personal data.
  • Opt–out of Sharing (for Cross-Context Behavioral Advertising, including Targeted Advertising) or Sale of Personal Data: You have the right to opt-out of the processing of your personal data for the purposes of targeted advertising or the sale of your personal data.
  • Deletion: You have the right to ask us to delete your personal data, subject to certain exceptions. Once we receive your request and verify your identity, we will delete your personal data from our records and direct our service providers to delete your personal data from their records, unless an exception applies under applicable law.
  • Portability: You have the right to request that your personal data be provided to you, or to another data controller, in a commonly used, machine-readable format.

How Long We Keep Your Personal Data

We will retain each category of personal data for as long as we deem reasonably necessary in connection with the purposes for which it was collected as described in this Policy or as otherwise permitted under applicable law. Specifically, we retain contact information submitted through inquiry forms for [5] years following your last interaction with us; we retain cookie and analytics data for [12] months; and we retain records related to privacy requests for [24] months, as required by law. We may retain personal data for longer periods where required by law or to establish, exercise, or defend legal claims.

Protection of Personal Data

We implement and maintain reasonable administrative, technical, and physical safeguards designed to protect your personal data against unauthorized access, disclosure, alteration, or destruction. These measures include [encryption of data in transit and at rest, access controls, employee training, and regular security assessments]. However, no method of transmission over the Internet or method of electronic storage is completely secure In the event of a data breach affecting your personal data, we will notify you and applicable regulatory authorities as required by law. Nothing in this Policy is intended to limit any rights you may have under applicable data breach notification or data protection laws.

Sensitive Personal Data

We do not collect sensitive personal information through the Site for purposes other than those permitted under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively “CCPA”) without your consent. To the extent we collect sensitive personal information, you have the right to limit our use and disclosure of such information to uses necessary to perform the services or provide the goods you request, or as otherwise permitted by law. If you engage with our health analytics services, additional privacy notices and terms may govern the collection and use of your sensitive personal data in that context.

Children’s Privacy

Our Site is not intended for use by children under the age of 16. We do not have actual knowledge that we sell or share the personal data of children under the age of 16.

Do Not Track

We will respond to Do Not Track browser settings.

Global Privacy Control

We recognize the Global Privacy Control (“GPC”) universal opt out preference signal. You may request to opt out of the sale, sharing (for cross context behavioral advertising, including targeted advertising) of your personal data by broadcasting the GPC on your browsers and/or browser extensions that support GPC. Where required by applicable law, we treat such signals as a valid request to opt out of the sale or sharing of personal data for the browser or device that communicates the signal.

California’s Shine the Light Law

California Civil Code Section 1798.83, known as the “Shine the Light” law, permits California residents to request and obtain from us a list of their personal data (if any) that we disclosed to third parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. Requests may be made only once a year and are free of charge. To make such a request, California residents may contact us using the contact details in the “Contact Information” section below.

Health Information

To the extent that we process data that meets the definition of protected health information (“PHI”) as defined under the Health Insurance Portability and Accountability Act (“HIPAA”), such processing is governed by our HIPAA Notice of Privacy Practices and applicable Business Associate Agreements, which are separate from this Policy. This Policy does not apply to PHI that we process in our capacity as a business associate under HIPAA. 

Information for Users Outside the United States

If you are located outside the United States, please be aware that personal data collected through the Site will be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction. By using the Site, you acknowledge this transfer. Where required by applicable law, we process your personal data on the following legal bases: (a) your consent, where you have provided it; (b) our legitimate interests in operating and improving the Site and marketing our services, provided such interests are not overridden by your data protection rights; or (c) compliance with a legal obligation.
